James Darmoody, per ship Castle Forbes, in government service, charged with refusing to work....James Gallaghar overseer of the wharf gang states - Darmoody belongs to my gang. I ordered him this morning to go into the water with others of the gang to assist in getting some logs to the wharf, but he refused to go. He afterwards in the presence of the Superintendent refused to go into the water, who inconsequence directed me to bring Darmoody before the Bench. The prisoner in his defence states - I told my overseer I could not go into the water on account of a complaint I have. I said I would do any other work in my power but going into the water does not agree with me. I am afflicted with a rupture and was 18 months in the hospital at Sydney under the care of Doctor Bowman. I have been obliged to wear a truss for a considerable time past and I always suffer from the chill of the water. Sentenced to 50 lashes. Altered by order of His Excellency the Governor to 3 months work in the gaol gang. Magistrates Francis Allman and Dr. George Brooks
